The Government seeks to dismiss LUMA's claims in the contract lawsuit

On July 15, 2026, Metro reports that the Puerto Rico Electric Power Authority and the Public-Private Partnerships Authority asked the Court of First Instance to dismiss LUMA Energy's claims within the lawsuit over the validity of the Extension Letter. That document, signed in November 2022, indefinitely extended the supplemental agreement that kept in force the transitional period in which the company operates transmission and distribution. LUMA filed on June 23 a counterclaim alleging, among other things, fraud in the formation and execution of the Extension Letter, unjust enrichment, contractual bad faith, and abuse of executive power.

In the July 13 motion, according to Metro, PREPA and P3 argue that the counterclaim lacks legal foundation and that most of the claims depend on the Extension Letter first being declared void, so they would be premature. They hold that the principal controversy is "strictly of law" and can be resolved by interpreting statutes and contracts, without a fact-finding process. The Government holds that the Extension Letter eliminated the supplemental agreement's 18-month limit and that that modification never obtained the Energy Bureau's Energy Compliance Certificate. Metro does not publish here LUMA's answer to that motion to dismiss. The request stands.

On July 8, Jenniffer González Colón accused LUMA of sowing chaos and hysteria amid those legal battles. On the 6th, LUMA warned of load shedding for lack of generation. A contract lawsuit, a press conference, and a load notice are three acts. The reader who wants the motion has the Metro URL at the foot.
