The Negociado deems Proponent No. 3's site control satisfied

On June 1, 2026, the Autoridad de Energía Eléctrica files before the Negociado de Energía, in docket NEPR-MI-2025-0005, a motion in compliance on Proponent No. 3. It reports that it met with the proponent and submits, with a confidentiality request, the Ground Lease and Purchase Option Agreement and its two amendments, a May 28 communication, a May 25 site-control memorandum, and a technical permits memorandum. On May 20 the Negociado had found discrepancies in property rights and permits. On June 5, with the signature of president Edison Avilés Deliz and of the associate commissioners, it determines that Proponent No. 3 satisfies the site-control requirement, unless AEE holds another interpretation of the agreements. The memorandum says the option is valid and enforceable, that the grantor may not sell or lease to a third party, and that the proponent has not yet exercised the purchase or the lease. The exact term of the option, the Negociado admits, is not unequivocal in the second amendment; it understands that the parties' intent is to give enough time if there is a contract.

On permits, the Negociado finds that Proponent No. 3's progress and strategy are consistent with what AEE has treated as reasonable for other proponents. It orders AEE and Proponent No. 3 to complete what remains in negotiation in 20 days and, at expiration, to report whether there is an agreement and to submit the proposed contract. It warns of fines under article 6.36 of Law 57-2014. The secretary's certification is dated June 5, 2026.
