Josué Colón Ortiz says the government will prevail against LUMA and cites 900 million extra

On August 9, 2026, Metro Puerto Rico reports that the energy czar and executive director of the Public-Private Partnerships Authority, Josué Colón Ortiz, said the government will prevail in the dispute against LUMA Energy. He spoke on Sunday, with Secretary of State Rosachely Rivera Santana, about a Supreme Court order of more than 76 pages. The government, he said, has the information to respond and will meet the 30-day term before it expires.

Josué Colón Ortiz questioned LUMA's narrative that the government does not honor the contract. According to the official, in five years the established charges have been paid and, in addition, more than 900 million dollars have been disbursed above the budgets approved for the consortium. That figure is his, published by Metro Puerto Rico. It is not turned here into an invoice audit.

He added that the contract sets the state forum for disputes, but that LUMA has gone to other forums. He put at more than 22 the court transactions in the Court of First Instance, the Supreme Court, Title III, and Boston, in 18 months. He also said LUMA has used only 6 percent of funds and reimbursements for completed work, against 11,000 million assigned since 2021. Those two magnitudes are the czar's via the outlet.

LUMA, according to the same note, argued in the counterclaim that the government itself presented and signed the extension in a legal manner. On August 5, El Nuevo Día covered the Supreme Court's 5-4 and the 30 days for briefs. This piece of the 9th does not rewrite that order: it covers Josué Colón Ortiz's press conference.

Anyone looking for the 76-page order or the breakdown of the 900 million has to go to the source. What Metro Puerto Rico left on August 9 is the czar's confidence, the deadline, the extra budget, and the 6 percent use. This is not original reporting.
