The Supreme Court takes up 5-4 the two suits to void the LUMA extension

On August 5, 2026, El Nuevo Día reports that the Supreme Court of Puerto Rico took up the government's two suits to cancel the LUMA Energy contract. The margin the outlet publishes is 5-4. The plaintiffs will have 30 days to present arguments that could result in voiding the electric-system operating pact. That decision, according to the coverage itself, is procedural: it does not yet rule on whether the Letter-Extension is valid or void.

The controversy, in the newspaper's summary, centers on the November 2022 agreement that allowed the LUMA supplemental contract to be extended until the Puerto Rico Electric Power Authority completes the restructuring of its debts. LUMA had begun operating the grid in June 2021 under an 18-month supplemental agreement that expired on November 30, 2022. The first suit was filed on December 11, 2025 by PREPA and the Public-Private Partnerships Authority; Governor Jenniffer González Colón filed a second action five days later.

LUMA removed the cases to federal court under Title III of PROMESA. Judge Laura Taylor Swain determined that both cases must be resolved under Puerto Rican law, and the First Circuit ordered that they continue their course while it hears an appeal by LUMA. Those layers are El Nuevo Día's. This note does not turn them into a ruling on the contract.

On August 9, Metro Puerto Rico covered Josué Colón Ortiz saying the government will prevail and that more than 900 million dollars have been paid above LUMA's budgets. That is another date and another URL. Here the fact is the 5-4, the 30 days, and the 2022 Letter-Extension.

The body of the El Nuevo Día page was truncated when opened. What remains is the headline, the dek of the 30 days, and the facts the outlet left in the opening paragraphs and in the public excerpt of the same text. A reader who wants the full resolution has the URL at the foot. This is not original reporting.
