The First Circuit rejects LUMA's stay and the case returns to the Supremo
On June 19, 2026, La Fortaleza headlines "Otro triunfo de la Gobernadora frente a LUMA." The release attributes to the Court of Appeals for the First Circuit, in Boston, an order that rejects LUMA's request to stay Judge Laura Taylor Swain's determination. That determination, La Fortaleza says, returns the LUMA-contract annulment case to the Tribunal Supremo de Puerto Rico. As a consequence of the order, on Monday June 22, 2026 the remand of the annulment cases to the Supremo takes effect and the annulment proceedings before the PROMESA court are dismissed.
Governor Jenniffer González Colón appears quoted: the government, she says, increases generation, works with the federal government, and rehabilitates plants, while attributing to LUMA transmission failures, office closures, and elimination of night brigades. Those phrases are La Fortaleza's, not a blackout balance assembled here. There is in the release no megawatt figure nor a count of hours without power.
La Fortaleza describes LUMA's strategy as procedural games: first remove the case to the federal sphere and then appeal the ruling against it. On June 23, Metro Puerto Rico would recount LUMA's counterclaim, already in local forums. On June 24, El Nuevo Día would quote Jenniffer González Colón calling those arguments "politiqueros." Those are other URLs. This note covers the First Circuit order La Fortaleza announced on the 19th.
Laura Taylor Swain is the Title III court judge; Puerto Rico's Supremo is the forum to which, according to this release, the annulments return on June 22. That Supremo's ruling is not anticipated here. Whoever wants the Boston order or the annulment file has the La Fortaleza URL. This is not original reporting.
