Microjuris Al Día: Ley 82-2026 closes the Article 14.1 injunction and charges 10% to halt a project

On May 25, 2026, Microjuris Al Día publishes attorney Daisy Calcaño López's column "La Ley 82-2026 y el acceso ciudadano a los tribunales". The outlet dates the piece that Monday. It is not La Fortaleza's May 12 box: it is the breakdown of how the law touches the statutory injunction of Article 14.1 of Law 161-2009.

According to Calcaño López, Ley 82 of May 12, 2026 requires private persons to allege a specific "imminent harm" and turns the statutory injunction into a traditional injunction in disguise. She cites Next Step Medical v. Bromedicon and A.R.Pe. v. Rivera. The State — Planning Board, municipalities of hierarchy I to III, government entities — keeps full standing. That asymmetry is the column's, not a recount by this magazine.

The same page puts the mandatory bond at no less than 10% of the project's value, with specialty over any other law. A 50 million project, she writes, requires 5 million; one of 2 million, 200,000 dollars. Those sums are Calcaño López's. She adds that the amendment to Article 6.007 of the Municipal Code opens exceptions to reclassify especially protected rustic land when the Government declares the project "strategic" or "critical" under Section 503 of PROMESA or Law 19-2017.

The column does not name a docket against the Governor. It speaks of a future vehicle case and of the colloquial phrase "a law to silence the people". This note does not turn that phrase into a ruling. On May 12, Metro Puerto Rico covered the signing. Here May 25 remains Article 14.1 and the bond. This is not original reporting.

Calcaño López attributes to the Statement of Motives an attack on Santiago De Alba v. Hernández Rivera, KLAN202300716. This page does not read that judgment. What remains is the date, the 10%, and the closing of the summary mechanism the outlet describes. A reader who wants the full column has the URL at the foot.
