Caribbean Business: Power Expectations sues PREPA over the canceled Aguirre PPOA

On September 3, 2026, Eva Llorens reports in Caribbean Business that Power Expectations, LLC sued the Puerto Rico Electric Power Authority (PREPA) in U.S. District Court, before Chief Judge Raúl Arias-Marxuach, over the cancellation of the temporary generation contract at Aguirre. The agreement, approved by the Financial Oversight Board, is put at about 5.8 to 5.9 billion dollars over ten years for 400 megawatts of emergency generation. The suit seeks declaratory relief, damages and an injunction against a new award. This note does not turn that figure into theft. The thread of the August revocation lives in other desk coverage: Board revokes the Power Expectations contract.

According to the complaint, PREPA did not deliver performance-bond language despite requests from July 9 to August 14, 2026; the assignment of Enchanted Rock’s role to Flotek Industries had already been approved by PREPA on July 31 under Article XVI of the PPOA; and the August 18 termination — with one day’s notice — would have followed the Board’s August 14 release revoking approval, not a contractual default with the 90-day notice the company claims for terminations without seller default. Power Expectations says it was investing millions and was ready to mobilize the first 40 megawatts; PREPA and the Partnerships Authority did not respond to CB.

The same 3PPO round produced a sister contract with Gothams Energy of about 2.4 billion for 200 megawatts of floating LNG generation in San Juan. On August 20, six days after the revocation, the Energy Bureau (PREB) ordered LUMA an updated ten-day evaluation of how much temporary generation is still needed. Rep. Víctor Parés Otero is reviewing amendments to Regulation 8815 to pull temporary-generation awards out of 3PPO and pass them to PREB. Separate pots: a federal lawsuit is not a House hearing.

What remains is 5.8 to 5.9 billion, 400 MW, the suit before Arias-Marxuach, and a no to theft as a headline. A reader who wants Eva Llorens on the 3rd has the Caribbean Business URL at the foot. This is not original reporting.
