The Board, through Proskauer, defends the revocation before the 3PPO

On August 21, 2026, El Nuevo Día covers an August 20 letter from Margaret A. Dale in which the Fiscal Oversight Board, through its adviser Proskauer, defends the revocation of the Power Expectations contract before the 3PPO. The contract, in this note, is $5,887 million. Dale, according to the outlet, holds that it was not necessary to resolve the fraud question in order to withdraw approval.

Mary Carmen Zapata Acosta canceled on August 18. The Board says Enchanted Rock was a premise of the approval. Power Expectations reserves the right to go to court. Those three facts belong to the August 21 coverage. There is no court ruling here, and no damages figure. There is a letter, a cancellation, and a reservation of litigation.

On August 14, the Board itself, at oversightboard.pr.gov, had announced the vote that revokes the contract: $5.9 billion, ten years, 400 megawatts, with Enchanted Rock saying on August 7 that its name and signature were used without authorization. On the 21st, NotiCel cited Governor Jenniffer González Colón: a contract that exceeds $5,800 million, and that she will demand accounts from the AEE, the APP, and Osvaldo Carlo Linares. On the 24th, El Nuevo Día attributed to Pablo José Hernández Rivera's letter to the DOE the figure of $5,900 million. This Proskauer piece uses $5,887 million. The layers are left in place.

The 3PPO, in the headline, is the office whose concerns the Board rejects. The fraud docket is not summarized, and this note does not say whether fraud occurred. What remains is Margaret A. Dale's thesis: withdrawing approval did not, in her view, require resolving that question. A reader who wants the full letter has El Nuevo Día's URL.

On August 18, NotiCel — in a note whose page body could not be opened — reported that the Senate asked for papers on the $5,887 million contract from Josué Colón Ortiz and Mary Carmen Zapata Acosta. That same 18th, La Perla del Sur, by snippet, covered New Fortress without a plan B. Those are neighboring threads. Today's is the legal defense of the revocation, dated in the August 20 letter and published on the 21st.
