Закон 91-2006: создан Фонд / Корпорация срочного интереса (COFINA)

On May 13, 2006, Act No. 91 — known as the Urgent Interest Fund Corporation Act (later associated with COFINA / Puerto Rico Sales Tax Financing Corporation) — was approved amid the FY2005–2006 fiscal crisis. The statement of motives recognizes decades of “extra-constitutional” debt without effective repayment methods, with impact on government credit, and places the escalation when spending again exceeded collections, “which has resulted in the layoff of over 95,000 government employees.”

The statute declares the FIA a special fund whose moneys will be used to cover the deficit thus generated, as well as other government debts and obligations that seriously affect credit. As part of a package to address that crisis, the law creates the Urgent Interest Fund (FIA) — originally attached to Hacienda — and a public corporation and instrumentality of the Government whose stated purpose is to use those moneys to cover the generated deficit and other debts and obligations affecting credit. Article 2.1 emphasizes separate legal existence from the Government and any other government entity, operated under its Board of Directors.

The OGP compilation (Rev. Apr. 16, 2024) identifies the piece as Act No. 91-2006 and lists later amendments (Act 291-2006; Act 56-2007; Acts 1 and 7 of 2009, among others) that expanded or reformed the vehicle — including the link to portions of the IVU. The peg of this note is the May 2006 creation date, not the post-PROMESA regime or later plan of adjustment. Authorized issuance ≠ disbursement. Creation of a refinancing vehicle ≠ theft.

Cousin: 667 (Act 117-2006 Tax Justice / IVU). Obligated ≠ disbursed ≠ theft. Primary: Act 91-2006 (OGP consolidated PDF; law date 2006-05-13).
