Primaria PDF: hudoig.gov/sites/default/files/2023-04/2023-AT-1002.pdf.

According to Amendment 8 of PRDOH’s action plan, effective 25 de febrero de 2022, PRDOH allocated $2.95 billion for its R3 program (Home Repair, Reconstruction, or Relocation). Allocated $2.95 billion en action plan ≠ drawn down.

Corte DRGR del propio OIG: as of 12 de septiembre de 2022, PRDOH had drawn down more than $1.11 billion in disaster funds, of which more than $573 million (about 52 percent) was charged to R3. Drawn down / charged to activity ≠ «robo»; es métrica de draw en el sistema de reporte de HUD. El objetivo de la auditoría: determinar whether PRDOH followed applicable program requirements when spending R3 program funds.

What We Found: PRDOH generally followed applicable program requirements; however, OIG identified four contracts where PRDOH may have used the prohibited cost-plus-a-percentage-of-cost (CPPC) contracting method to acquire program management services. PRDOH itself was concerned y amended three of the contracts «in order to clarify that the agreement is not a cost-plus-percentage-of-cost contract.» At OIG’s request, HUD obtained a legal opinion from its Office of General Counsel, which opined that the contracts in question did not constitute a CPPC contract. What We Recommend: This report contains no recommendations. OIG sigue troubled by the manner in which PRDOH handled these four contracts, especially before HUD’s 2019 monitoring review, y cree prudent additional monitoring of PRDOH’s contracting actions.

Marco legal CPPC citado: 24 CFR 570.489(g) y jurisprudencia; States (including Puerto Rico) are prohibited from using CPPC because contractors are penalized for efficient performance and rewarded for non-economical performance. El Comptroller General four-part test: (1) payment on a predetermined percentage rate; (2) percentage applied to actual performance costs; (3) contractor’s entitlement uncertain at award; (4) entitlement increases commensurately with increased performance costs. OIG argumentó que los cuatro contratos (AECOM; Alliance for the Recovery of Puerto Rico; ICF, Incorporated, LLC; Innovative Emergency Management, Inc.) arguably met the criteria: hourly billing plus overhead at a fixed percentage of billable rates and profit at a fixed percentage of billable hours and overhead; rates applied to actual monthly labor; entitlement uncertain up to a 200-hour cap; entitlement rising with hours billed.

Como las enmiendas ocurrieron before billing concluded, OGC no vio basis to conclude with certainty that the PM contracts were prohibited CPPC.

OIG revisó public laws, FR notices, grant agreements 2018 y 2020, action plans, independent auditor reports FY2017–2019, HUD monitoring, QPRs, DRGR drawdowns, disbursement register, trial balances, bank accounts, procurement register. Results apply only to expenditures reviewed; cannot be projected to the universe. GAGAS compliance afirmada.

$19.9 billion announced (2018) ≠ $1.507 billion primer grant agreement ≠ $2.95 billion R3 allocation en Amendment 8 ≠ $1.11 billion drawn ≠ $573 million charged to R3 ≠ $35 million PM transactions revisadas ≠ robo.

No recommendations ≠ absence of risk. OGC opinion ≠ OIG endorsement of all PRDOH procurement. $2.95 billion allocated (action plan) ≠ $573 million charged to R3 ≠ nearly $35 million PM transactions reviewed. Allocated ≠ obligated ≠ disbursed ≠ outlayed ≠ robo. Primaria: hudoig.gov 2023-04/2023-AT-1002.pdf; slot 23 abr 2023; peg 31 mar 2023.
